Terms of Service

You must be at least 18 years old and legally capable of entering into a binding agreement to use OhhMy.

If you use OhhMy on behalf of a business or organization, you represent that you have authority to bind that organization to these Terms.

OhhMy is an AI-powered social media management and brand-intelligence platform.

Features may include:

• Brand Hubs
• Brand DNA and brand intelligence
• AI-assisted content creation
• Content Studio
• platform-specific content variants
• 30-Day Content Planning
• Campaign Builder
• Content Calendar
• Media and Content Library
• social-account integrations
• publishing tools
• analytics
• AI strategy tools
• inbox and engagement tools
• repurposing and automation

Some features may be labeled Coming Soon, beta, preview, experimental, or otherwise unavailable.

We may add, modify, improve, suspend, or discontinue features over time.

You are responsible for:

• providing accurate account information
• maintaining the confidentiality of your login credentials
• activity performed through your account
• keeping your contact and billing information current
• promptly notifying us of suspected unauthorized access

You may not share credentials in a way that exceeds the account or seat limits of your subscription.

You may upload or provide information including:

• brand information
• logos
• images
• videos
• documents
• social content
• campaigns
• audience information
• brand voice instructions
• platform details
• other materials

You retain ownership of content and intellectual property you provide to OhhMy.

You grant OhhMy a limited license to host, process, reproduce, transform, and otherwise use your submitted content only as reasonably necessary to provide, secure, maintain, and improve the services you request.

You represent that you have the rights necessary to upload and use the materials you provide.

OhhMy may use artificial intelligence to help generate or recommend:

• captions
• content ideas
• hooks
• platform variants
• campaigns
• content plans
• graphics
• strategy suggestions
• responses
• other materials

AI-generated output may be incomplete, inaccurate, repetitive, inappropriate, or unsuitable for a particular purpose.

You are responsible for reviewing and approving content before publishing, distributing, relying upon, or using it commercially.

OhhMy does not guarantee that AI-generated content is unique, error-free, legally compliant, non-infringing, or appropriate for your audience.

AI-generated content is not legal, financial, medical, accounting, or other professional advice.

OhhMy may connect with third-party platforms such as Facebook, Instagram, TikTok, YouTube, LinkedIn, and others.

Your use of those platforms remains subject to their own terms, policies, permissions, API restrictions, and availability.

OhhMy does not control third-party platforms and is not responsible for:

• platform outages
• API limitations
• account restrictions
• removed permissions
• publishing failures caused by third parties
• changes to third-party features or policies

A feature may stop functioning if a third-party platform changes or removes access.

OhhMy may offer monthly and annual subscriptions.

Current planned pricing includes:

• Solo: $29/month or $290/year
• Growth: $59/month or $590/year
• Scale: $99/month or $990/year
• Agency: $179/month or $1,790/year

Pricing may change for future purchases or renewals. Any pricing changes will be communicated as required by applicable law.

Eligible customers may receive a 7-day free trial for the paid plan they select.

A valid payment method may be required to begin the trial.

Unless you cancel before the trial expires, your selected subscription will automatically begin and your payment method will be charged the applicable monthly or annual subscription fee.

You are responsible for canceling before the trial ends if you do not want to be charged.

OhhMy may limit trial eligibility to prevent abuse or repeated trial use.

Paid subscriptions automatically renew at the applicable billing interval unless canceled before the next renewal date.

By subscribing, you authorize OhhMy and its payment processor to charge the payment method associated with your account for recurring subscription fees, applicable taxes, and authorized charges.

OhhMy may offer a limited Founding Access subscription.

The planned Founding Access offer is:

• $39/month
• available to the first 100 eligible founding customers
• up to 5 Brand Hubs
• Growth-level feature access
• locked subscription rate while the subscription remains continuously active

If a Founding Access subscription is canceled, terminated, allowed to lapse, or otherwise becomes inactive, the locked founding rate is forfeited.

If the customer later returns, the then-current pricing will apply.

Founding Access does not guarantee that every future OhhMy feature will be included without additional charge.

You may cancel your subscription at any time.

If you cancel:

• future renewals will stop
• your paid access generally continues through the end of the current paid billing period
• unused time is not prorated or refunded unless required by law

Cancellation during an eligible free trial prevents the first paid subscription charge if completed before the trial expires.

Subscription charges are generally final and non-refundable once processed.

Refunds may be provided for:

• duplicate billing
• confirmed billing errors
• circumstances where a refund is required by applicable law
• another written exception expressly approved by OhhMy

We do not generally issue refunds because:

• the service was not used
• all Brand Hubs were not used
• all AI allowances were not used
• the customer forgot to cancel
• the customer changed their mind after a charge
• a customer did not use the remainder of a billing period

You may not use OhhMy to:

• violate applicable law
• infringe intellectual property rights
• impersonate another person or organization
• distribute malware or malicious code
• gain unauthorized access to accounts or systems
• harass, threaten, exploit, or deceive others
• generate or distribute unlawful content
• interfere with OhhMy's systems or security
• abuse AI, platform, publishing, or account limits
• resell or reverse engineer the platform except where expressly permitted

We may restrict or terminate access for material violations.

OhhMy and its software, interfaces, branding, designs, code, workflows, documentation, trademarks, and proprietary technology are owned by or licensed to V2V Consulting LLC.

These Terms do not transfer ownership of OhhMy intellectual property to you.

We aim to provide reliable access but do not guarantee uninterrupted or error-free service.

Maintenance, upgrades, third-party outages, security events, internet failures, API changes, or other circumstances may temporarily affect availability.

We may suspend or terminate access where reasonably necessary because of:

• nonpayment
• fraud
• security concerns
• abuse
• illegal activity
• material violation of these Terms

Where appropriate, we may provide notice and an opportunity to correct the issue.

OhhMy is provided on an “as is” and “as available” basis to the maximum extent permitted by law.

We do not warrant that:

• every feature will always remain available
• AI output will always be accurate
• social platforms will accept every post
• the service will achieve specific business or marketing results
• generated content will be free from errors or third-party claims

To the maximum extent permitted by applicable law, V2V Consulting LLC d/b/a OhhMy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service.

Where liability cannot legally be excluded, our aggregate liability will be limited to the amount you paid OhhMy during the twelve months preceding the event giving rise to the claim, unless applicable law requires otherwise.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer or other laws provide rights that cannot legally be waived.

We may update these Terms from time to time.

Material changes will be communicated where required.

Continued use of OhhMy after updated Terms become effective constitutes acceptance of those updated Terms where legally permitted.
